1. INTRODUCTION
Experience Turks and Caicos (“we,” “us,” “our”) is the official Destination Management Organisation of the Turks and Caicos Islands, established as a statutory body under the laws of the Turks and Caicos Islands. Our registered office is located at The Regent Village, Unit H205, Grace Bay Road, Providenciales, Turks and Caicos Islands, TKCA 1ZZ.
We are committed to protecting the privacy and personal information of all individuals who interact with us, whether through our website, by telephone, by post, or by any other means. This Privacy Policy explains what personal information we collect, how we use it, with whom we may share it, and the rights you have in relation to it.
This Privacy Policy applies to all websites owned, published, or operated by Experience Turks and Caicos (collectively, the “Website”). It does not govern the privacy practices of third-party websites, platforms, or services linked to or integrated with our Website (including, but not limited to, social media platforms such as Facebook, Instagram, and YouTube, or our sponsors and commercial partners).
By using our Website, you signify your consent to the collection, use, storage, and disclosure of your personal information in accordance with this Policy. If you do not agree with this Policy, please do not use our Website.
2. LEGAL FRAMEWORK
The Turks and Caicos Islands is a British Overseas Territory and a common law jurisdiction. While the TCI does not currently have standalone comprehensive data protection legislation, the following legal instruments are relevant to the collection, use, and protection of personal information by Experience Turks and Caicos:
2.1 Turks and Caicos Islands Law
- The Constitution of the Turks and Caicos Islands (2011) – Section 9(1) provides that every person has the right to respect for his or her private and family life, home, and correspondence. No person shall be subjected to search or unauthorised entry without consent. Experience Turks and Caicos interprets this right broadly to include the protection of personal data.
- The Confidential Relationships Ordinance (TCI) – Imposes statutory obligations of confidentiality on persons who come into possession of confidential information arising in or brought into the Islands in a professional context. Experience Turks and Caicos treats personal information provided to us as confidential and will not disclose it except as permitted by law or with your consent.
- The Electronic Transactions Ordinance (TCI) – Provides a framework for electronic transactions, including provisions relating to personal data processed in connection with electronic transactions. While implementing regulations have not yet been enacted, Experience Turks and Caicos complies with the spirit of this Ordinance.
- Common Law – As a common law jurisdiction, TCI follows English court precedent (except where local statutes provide otherwise). The principles established in Coco v A N Clark (Engineers) Ltd 1969 RPC 41 and subsequent authorities provide an actionable right of breach of confidence where: (i) the information is of a confidential nature; (ii) the information was communicated in circumstances importing an obligation of confidence; and (iii) there was an unauthorised use or disclosure of the information.
2.2 International Standards
As a statutory body operating in an international tourism context, and given that many of our users and visitors originate from jurisdictions with comprehensive data protection legislation, Experience Turks and Caicos also draws on the following international frameworks:
- The United Kingdom General Data Protection Regulation (UK GDPR) as supplemented by the Data Protection Act 2018 – Applied in respect of data subjects who are residents of the United Kingdom.
- Regulation (EU) 2016/679 – the General Data Protection Regulation (GDPR) – Applied in respect of data subjects who are residents of the European Union or the European Economic Area.
- The Caribbean Community (CARICOM) Model Data Protection Legislation – Adopted as a benchmark of regional best practice for the Caribbean.
Where the applicable law of a visitor’s home jurisdiction provides stronger protections than those described in this Policy, we will endeavour to apply the higher standard to the extent reasonably practicable.
3. CHILDREN'S PERSONAL INFORMATION
Our Website is not directed to children under the age of 16. We do not knowingly collect personal information from children under the age of 16 without the prior, verifiable consent of a parent or legal guardian. If we become aware that we have inadvertently collected personal information from a child under 16 without appropriate consent, we will take prompt steps to delete such information from our records. If you believe that we may have collected information from a child under 16, please contact us at info@visitturksandcaicos.com.
